Merits Review Tribunal Amalgamation

On 1 July 2015, the Migration Review Tribunal (MRT) and the Refugee Review Tribunal (RRT) amalgamated into the Administrative Appeals Tribunal (AAT). This means that matters previously dealt with by the MRT and RRT can only be undertaken by the Migration and Refugee Division (MRD) of the AAT. Under transitional provisions, all unfinalised applications as of 30 June 2015 were, on 1 July 2015, automatically transferred to, and are to be decided by, the MRD of the AAT. Examples of migration decisions that can be reviewed by the AAT include: the refusal to grant visas; cancellation in Australia of certain visas; points test assessments; business sponsorship/nomination schemes; securities on bridging visas; and a decision not to revoke the automatic cancellation of student visas. Examples of refugee decisions that can be reviewed by the AAT include decisions to refuse to grant or cancel certain protection visas.
