COVID-19 Information for overseas visitors holding a Visitor visa or Electronic Travel Authority visa

Coronavirus COVID-19 Information for overseas visitors holding a Visitor visa or Electronic Travel Authority

May 2020

The Australian Government has indicated that tourists currently in Australia should return to their home countries amid Coronavirus outbreak.

Visitor visa and Electronic Travel Authority holders are not permitted to work in Australia.

However, if you cannot return to your home country, you can apply for another visa to permit you to stay in Australia.

It is not possible to extend a visa in Australia, therefore you must apply for a new visa.

It is extremely important that you apply for a new visa before your current visa expires. If you fail to do that, you will be unlawful in Australia and that will make it almost impossible to obtain another visa.

You may be able to apply for a further Visitor visa or a visa of another class if you meet the requirements. You may also be able to apply for a Medical treatment visa if you require any medical treatment.

No Further Stay Condition

If your current visa has a “No Further Stay” condition (8503, 8534 and 8535) and you are unable to leave Australia, you can apply to have the condition waived.  You need to do this as early as possible as it will take some time for the Department of Home Affairs to process the waiver request.  You cannot apply for a new visa until the waiver has been approved.

Condition 8531 (Must not stay in Australia beyond the period of stay permitted by the visa)

If you hold a visa with condition 8531 and cannot leave Australia, you must apply for a further visa before your visa expires.  If you also have condition 8503, you will need to request a waiver of that condition first. Again, you need to do this as early as possible so that you can apply for a new visa before your current visa expires.
